Court of Appeals Reverses Summary Judgment Award, Accepts Co-Worker Affidavit

SALEM, Ore. -- A Court of Appeals has reversed a summary judgment award to a supplier defendant, ruling that an affidavit presented by the decedent's co-worker did not need to validate that his statement in the affidavit was based on personal knowledge. West v. Allied Signal, et al., No. 0207-06814; A122831 (Ore. Ct. App.).

The June 15 decision by the Court of Appeals reversed the award of summary judgment to supplier defendant La Grand Industrial Supply Co., finding that there is sufficient evidence indicating that the defendant supplied the foundry where the decedent worked in asbestos gloves.
