PHILADELPHIA -- A Pennsylvania Court has upheld the dismissal of a dissolved company from an asbestos lawsuit, finding that the claims asserted against the company failed because they had yet to mature. Erderly, et al. v Hinchcliffe and Keener, Inc., et al., No. 1883 WDA 2003 (Pa. Super. Ct.).
In an April 25 opinion, the Superior Court of Pennsylvania affirmed the dismissal of Hincliffe and Keener Inc. from a class action complaint, and further affirmed that the defendant's insurance companies were not obligated to pay for the plaintiff's alleged injuries.
