SAN FRANCISCO -- A California appellate court has affirmed summary judgment awarded to a contractor, considering but rejecting the asbestos plaintiff's assertion that the company exercised control over the work site just prior to the plaintiff's employment. Johnson v. Cahill Contractors, et al., No. A107442 (Calif. Ct. App., 1st Dist., Div. 1).
In an April 25 opinion, the First Appellate District for the California Court of Appeals opined that while the trial court had wrongfully excluded the testimony offered by the plaintiff, that exclusion did not raise a triable issue of fact warranting a reversal of summary judgment.
