N.Y. Court Affirms Orders Dismissing Several Asbestos Defendants

BUFFALO, N.Y. -- A state appellate court has upheld the dismissal of three asbestos defendants, rejecting the plaintiffs' contention that the lower court erred when failing to grant the plaintiffs an extension of time to effect service. Eggleston, et al. v. ACandS Inc., et al., No. CA 04-02776 (N.Y. Sup. Ct., App. Div., 4th Dept.).

The recent order entered in the 4th Department of the New York Supreme Court Appellate Division effectively affirmed the dismissals of Borg-Warner Corp., Honeywell International, Inc. and DaimlerChrysler Corp.
