Appeals Court Reverses Summary Judgment Awarded to Distributor Defendants

LOUSIVILLE -- A Kentucky appellate court has reversed summary judgment awards to two asbestos defendants, finding that the plaintiff presented sufficient evidence suggesting that the defendants knew, or reasonably should have known, about dangers of asbestos-containing products they distributed. Parker v. Henry A. Petter Supply, et al., No. 2004-CA-000259-MR (Ken. Ct. App.).

In an April 1 opinion, the Kentucky Court of Appeals found that the summary judgment award was 'premature,' and remanded the claims for further investigation into whether a triable issue exists relating to the extent of the distributor defendants' knowledge of asbestos dangers.
