Court Struggles with Admitting Evidence of Exposure to Other Asbestos-Containing Products

DANVILLE, Ill. -- An Illinois court has denied post-trial motions in an asbestos lawsuit that ended in a plaintiffs' verdict, but has expressed concern with the inconsistencies in rulings on whether to allow evidence of exposure to other asbestos-containing products. Nolan, et al. v. Weil-McLain, No. 01-L-117 (Ill. 5th Jud. Cir., Vermilion Cty.).

The March 18 ruling issued by the Illinois Fifth Judicial Circuit for Vermilion County ultimately denied the post-trial motions of defendant Weil-McLain in the approximately $2.3 million verdict, but expressed 'reluctance' to comply with case law precluding the admittance of evidence of exposure to other asbestos-containing products.
