PHILADELPHIA -- In a recently filed brief supporting their second global motion for summary judgment, asbestos defendant Crown Cork & Seal has argued that a Pennsylvania statute limiting tort liability to successor defendants is constitutional and additionally that the plaintiffs have no standing to challenge the issue. In re: Asbestos Litigation, No. 1986-0001 (Pa. Ct. Comm. Pls, Philadelphia Cty.).
On Jan. 31, Crown Cork & Seal filed the reply brief in the Philadelphia Court of Common Pleas, arguing that the court has already rejected the plaintiffs' argument that the Statute is unconstitutional.
