Court Rejects Plaintiff's Reliance on Brake Pad Replacement Testimony as Basis for Product ID

SEATTLE -- Washington's Court of Appeals has affirmed summary judgment for Bendix Inc., rejecting the plaintiff's contention that his recollection of brake replacement procedures implicated Bendix's product as one that exposed the plaintiff to asbestos. Brown, v. Allied Corp., et al., No. 54039-4-I (Wash. Ct. App.).
In a March 7 opinion, the Court of Appeals stated that plaintiff Owen Brown could not recall whether Bendix specifically manufactured the products he claims caused his mesothelioma.
