DALLAS -- Kelly-Moore Paint Co. has filed a motion for sanctions against Eric Birge of Brent Coon & Associates, claiming the plaintiff's attorney threatened the asbestos defendant's counsel during and after a deposition in an underlying asbestos lawsuit. Jackson, et al. v. American Standard, et al., No. 03-04947 (Texas 14th Jud. Dist. Ct., Dallas Cty.).
In a Jan. 27 motion filed in the Texas 14th Judicial District Court for Dallas County, Kelly-Moore contends that its attorney, Christopher Ege of Brown McCarroll, did not act towards Birge in a rude or unprofessional manner.
