Georgia Appeals Court Affirms Defense Verdict in Mesothelioma Lawsuit

ATLANTA -- The Georgia Court of Appeals has upheld a defense verdict for Union Carbide in a mesothelioma lawsuit, rejecting the plaintiff's argument that the trial court erred when failing to admit evidence concerning the composition of the asbestos compound that allegedly caused the plaintiff's injury. Flowers, et al. v. Union Carbide, et al., No. A04A1854 (Ga. Ct. App.).
In a Jan. 27 decision, the appeals opined that the plaintiff had numerous opportunities to present supplemental evidence during trial after the court had precluded certain statements made by a defendant dismissed from the proceedings.
