Court Affirms Summary Judgment Award to Owens-Illinois in Kaylo Exposure Case

SAN FRANCISCO -- A California Appeals Court has affirmed an award of summary judgment to asbestos defendant Owens-Illinois, ruling that the plaintiff's alleged exposure to the company's asbestos-containing product occurred years after Owens-Illinois had relinquished control over the product. Cadlo, et al. v. Owens-Illinois, No. A105444 (Calif. Ct. App., 1st Dist., Div. 5).
In a Nov. 30 decision, the Fifth Division of the First District of the California Court of Appeals found that the plaintiffs failed to produce evidence that the plaintiff's alleged exposure occurred when Owens-Illinois had control over the asbestos insulation product, Kaylo.
