Pa. Court Affirms Dismissal of Kansas Resident's Asbestos Claim

PHILADELPHIA -- A Pennsylvania appeals court has upheld a decision dismissing a Kansas resident's asbestos claim, after determining that the case had no relevant ties to Pennsylvania that support the plaintiff's decision to file the case there. Jessop, et al. v. ACF Industries, et al., No. 394 EDA 2004 (Pa. Super. Ct.).
In a Sept. 23 published opinion, the Pennsylvania Superior Court agreed with the trial court's assessment that since the alleged exposure occurred entirely in Kansas, and nearly all other ties to the claim reside in the state, Kansas is the proper venue for the case.
