New York Judge Joins Six Mesothelioma Plaintiffs for Trial




NEW YORK -- A New York Court has granted, in part, a motion by plaintiffs to consolidate 10 plaintiffs' asbestos claims for trial purposes, ordering joint trials for six of the plaintiffs, and severing the trials of the four remaining plaintiffs. Boccia, et al. v. A.O. Smith Water Products, et al., No. 119366/03 (N.Y. Sup. Ct., N.Y. Cty.).

Entered Aug. 27 by Judge Louis B. York of the New York Supreme Court for New York County, the order opined that prejudice is not a factor since all of the plaintiffs allege they were exposed to asbestos and subsequently developed mesothelioma. …
