Ohio Appeals Court Affirms Workers' Comp Judgment for Asbestosis Sufferer

YOUNGSTOWN, Ohio- An Ohio State Court of Appeal on May 11 affirmed a worker's compensation judgment for an asbestosis sufferer after it determined that the claim was timely filed despite the disputed date of an X-ray. Chieffo v. YSD Industries, Inc., et al. No. 03MA47 (Ct. App. Ohio, Mahoning Cty.).

The only issue raised on appeal was whether the Mahoning County (Ohio) Court of Common Pleas erred in denying summary judgment to YSD Industries Inc., on the claim by retired worker Carl Chieffo.
