NEW YORK - A New York State Supreme Court judge on June 4 denied a boiler manufacturer's motion for summary judgment, saying the company is still bound by an agreement to assume liability for injuries resulting from a predecessor's products. Anastasio v. A.O. Smith Water Products, et al., No. 0105467/03 (N.Y. Sup. Ct., New York Cty.).
Justice Helen E. Freedman denied OakFabco Inc.'s explanation that it was not liable for the injuries to Edward Anastasio, an electrician who wired Kewanee boilers between 1965 and 1980.
