Texas Judge Denies Forum Motion in Mich. Resident's Case, Advises Against Future Filings

WHARTON, Texas - The judge overseeing the Texas state court asbestos MDL has denied a motion to dismiss a Michigan plaintiff's exposure claim for lack of jurisdiction, but has cautioned counsel filing cases on behalf of out-of-state plaintiffs that it may be difficult for them to get expedited trial settings in the future. Pomranky v. Garlock, Inc., et al., No. 38,960-S (Texas Dist. Ct., Wharton Cty.).

In a ruling issued May 24, Judge Mark Davidson said he had no other choice under Texas law but to allow the Michigan plaintiffs case to remain in Texas. Judge Davidson noted that a …
