SAN FRANCISCO - A group of 174 seamen who claimed they were exposed to asbestos while working aboard two U.S. cruise ships has again lost its bid for damages that would have covered medical monitoring costs. In re: Marine Asbestos Cases, Nos. 99-16183-16657 (9th Cir.).
The Ninth Circuit U.S. Court of Appeals on Sept. 10 upheld a previous ruling by a U.S. District Court, finding that the seamen were not entitled to medical monitoring benefits under the Jones Act because none had not suffered from an asbestos-related disease.
