INDIANAPOLIS - An Indiana appeals court has ruled that a widow's wrongful death suit was not barred by Indiana's 10-year statute of repose, reversing the trial court's summary judgment in part and remanding the case as to two defendants. Poirier v. A.P. Green Services, Inc., et al., No. 45A03-9910-CV-388 (Ind. Ct. App., 3rd Dist.).
In its August 31 ruling, the Court of Appeals of Indiana also affirmed the lower court's decision in favor of four defendants for lack of product identification.
