WASHINGTON, D.C.- A United States District Court judge has denied a motion to dismiss a complaint filed against a construction company under the False Claims Act, in which the plaintiff asserted that the company lied to the government about wage rates and the proper disposal of asbestos material. Michael M. Allen v. Beta Construction, et al. No. 01-1182 (EGS) (D. D.C.)
In a March 24 opinion, Judge Emmet G. Sullivan stated that plaintiff Michael M. Allen has fulfilled the provisions of the False Claims Act against Beta Construction, and provided sufficient detail at this preliminary stage of litigation.
