DENVER - A construction worker whose asbestos-related injury surfaced several years after the insolvency of his employer's workers' compensation insurer cannot collect benefits because he failed to file his claim on time, a Colorado appeals court has affirmed. Alexander v. Industrial Claim Appeals Office of Colorado, No. 00CA1061 (Colo. App.).
The Colorado Court of Appeals on Aug. 16 upheld a ruling by the state's Industrial Claim Appeals Office, which had ruled that the deadline for filing claims with the guaranty association set up to cover the insolvent insurer did not violate claimant Esmel Alexander's constitutional rights.
