Federal Court Dismisses Insurance Co., Finds No Misrepresentation Made

WHEELING, W.Va. -- A judge has dismissed an insurance company from an asbestos-related action, finding that the company did not misrepresent to the plaintiffs amounts that were available under policies. Ayers, et al. v. Continental Casualty Co., et al., No. 05-00095 (N.D. W.Va.).

In the Feb. 2 decision, Judge Frederick P. Stamp Jr. of the U.S. District Court for the Northern District of West Virginia dismissed Allegheny Insurance Co. from the complaint and denied the plaintiffs' motion to remand.

The instant action was filed against Continental Casualty Co. and Allegheny, who were the insurers of Valley Supply Co. Jurors entered …
