TOLEDO, Ohio - An Ohio federal judge on Feb. 26 remanded a wrongful termination case after dismissing the only federal law claim. Dale Lawrence, et al. v. Dixon Ticonderoga Company, et al. Case No. 3:03 CV 7117 (N.D. Ohio)
Judge David A. Katz found that plaintiffs Dale Lawrence and Clayton Greene, former employees of Dixon Ticonderoga Co., did not follow a four-step grievance procedure as outlined in the company's collective bargaining agreement (CBA) and cannot pursue a federal claim for intentional infliction of emotional distress.
