H.K. Porter Is Second Plaintiff to Withdraw Contribution Suit Against Big Tobacco

NEW YORK - H.K. Porter has become the second plaintiff in less than a month to voluntarily withdraw its lawsuit against Big Tobacco seeking reimbursement for money paid to asbestos claimants who also smoked. H.K. Porter Company, Inc. v. B.A.T. Industries, et al., No. CV-97-7658 (E.D. N.Y.).
In a stipulation of dismissal filed July 16 in the U.S. District Court for the Eastern District of New York, the trust voluntarily dismissed the lawsuit, effectively giving up its right to refile the suit, according to a statement issued by Philip Morris.
