N.C. Appeals Court Upholds $60,000 Award for Asbestosis, Colon Cancer Claim

RALEIGH, N.C.-A North Carolina Court of Appeals recently affirmed a Workers' Compensation Committee's decision to award $60,000 to a man who developed asbestosis and colon cancer as a result of occupational exposure to asbestos, finding that the amount was adequate since the injuries involved three vital organs. Jessie Bill Childress v. Fluor Daniel, Inc. and Kemper Insurance Company, No. COA03-107 (N.C. Ct. App.)

In its Feb. 3 opinion, the court disagreed with defendant Fluor Daniel, Inc.'s claim that the North Carolina Industrial Commission (NCIC) erred in denying its motion to withdraw the award. The company had also argued that $40,000 …
