Pa. Appellate Court Reverses Summary Judgment Award to Union Carbide

HARRISBURG, Pa. –– A Pennsylvania appellate court has reversed an award of summary judgment to Union Carbide, ruling that the trial court wrongfully excluded an interrogatory answer the plaintiffs provided in attempts to establish product identification. Petrina, et al. v. Allied Glove Corp., et al., No. 894 WDA 2011 (Pa. Super. Ct.).
In the June 8 ruling, the Pennsylvania Superior Court ruled that the answers, which indicated that Union Carbide provided asbestos incorporated into products with which the decedent worked, should have been included in the evidentiary record.
