Appeals Court Rules Asbestos Plaintiffs Can't Seek Damages from Dissolved Corporation

LANSING, Mich.-A Michigan Court of Appeals has reversed a decision that allowed several asbestos claimants to seek compensation from a now-extinct corporation more than a year after the company liquidated its assets and published notice of its dissolution. Gilliam, et al. v. Hi Temp Products Inc. et al., Nos. 238102, 238224, 238341, 238375 (Mich. Ct. App.).
On Dec. 18, the appeals court found that the trial court erred when it denied defendant Hi Temp Products' attempts to bar the plaintiffs' post-dissolution claims for personal injury caused by exposure to the company's asbestos-containing products.
