Last October, a week after Senate Bill 1125's chances for passage were bolstered by a deal between insurers and asbestos defendants on how much each would contribute to the trust fund proposed under the bill, several U.S. Senators received a letter asking them not to support the plan.
The letter, which came from a group that, at first glance, one might not consider a likely source of dissent, read to some degree: Don't support S. 1125; we know it won't work. If you decide to enact the measure, it will be challenged based on constitutional grounds.
