NEW YORK ---- A New York jury has found a tobacco company defendant was not liable for claims asserted by a 40-year smoker who alleged that his lung cancer was caused by exposure to both asbestos and tobacco. Gadaleta, et al. v. ACandS, et al., No. 110739/02 (N.Y. Sup. Ct., N.Y. Cty.).
In the unanimous Oct. 29 verdict in the New York Supreme Court for New York County before Judge Karen Smith, the jury determined the plaintiff did not present sufficient evidence indicating that he smoked cigarettes with asbestos-containing filters.
