Court Rejects Attempt to Preclude Evidence Involving Friction Products

NEW YORK -- A New York court has rejected DaimlerChrysler's attempts to preclude testimony implicating friction products in the development of asbestos-related diseases, opining that while epidemiological evidence has become the 'gold standard' for causation, such evidence is not necessary to establish a causal link. Berger, et al. v. Amchem Products, et al., No. 107764/04; Nygaard, et al. v. Amchem Products, et al., No. 107690/04 (N.Y. Sup. Ct., New York Cty.).
