Court Affirms Decision to Exclude Testimony on Friction Product Market Share

SAN FRANCISCO - A California appeals court has affirmed a grant of nonsuit to two friction products defendants after the plaintiff was unable to support his market share liability claims with evidence that the products were fungible. Campbell v. Maremont Corp., No. A099765 (Calif. App. Ct., First Dist.).
The First District Court of Appeal issued the decision Sept. 26, determining that the trial court did not abuse its discretion when it ruled that the plaintiff's expert - while knowledgeable regarding asbestos exposure - did not have specific expertise in the area of the friction products in question.
