Kin of Shipyard Worker Failed to Produce Evidence of Exposure to 3M Tape, Court Says




NEW ORLEANS - A state appeals court has dismissed claims against the 3M Co., that were filed by the family of a former shipyard worker who alleged that the company's asbestos tape product caused the worker's mesothelioma. Booth, et al. v. ACandS, Inc., et al., No. 2003-C-0511 (La. Ct. App., Fourth Cir.).

In an opinion issued Aug. 13, the Fourth Circuit Louisiana Court of Appeal reversed a trial court decision to deny 3M summary judgment in the case. The appeals court ruled there exists an issue of material fact as to whether 3M made an asbestos-containing tape product used by …
