Judge Denies Motion to Reconsider SV40 Daubert Ruling

LOS ANGELES - A federal judge who recently allowed testimony concerning the link between Simian Virus 40 and the infection and cancer-related death of a young California boy has refused to reconsider his subsequent decision to award summary judgment to defendants in the case.
Judge William Rea of the U.S. District Court for the Central District of California ruled June 19 that he would not reconsider the summary judgment award, which followed a determination that the plaintiffs had failed to provide evidence that the boy's SV40 infection was caused exclusively by exposure to a contaminated vaccine.
