Statute of Repose Bars Asbestos Claim Against Contractors

INDIANAPOLIS - A state appeals court has reversed a trial court's decision to deny summary judgment to a group of contractors that installed asbestos-containing products which allegedly caused a plaintiff's development of lung cancer. J.M. Foster, Inc. v. Carol Lou Spriggs, No. 49A05-0111-CV-508 (Ind. App. Ct., Fifth Dist.).

The Indiana Fifth District Court of Appeals issued the decision June 5, determining that the state's construction statute of repose applied to bar claims that the contractors were responsible for the asbestos-related death of Charles R. Spriggs.
