FELA Plaintiff Appealing Ohio Asbestos Defense Verdict




CLEVELAND - A former rail worker who was unsuccessful in getting a jury to agree that his lung cancer was asbestos-related has appealed the verdict. Kilbane v. Consolidated Rail Corp., et al., No. CA-03-082397 (Ohio Ct. App., Eighth Dist.).

The appellant's brief was filed May 23 in the Eighth Appellate District on behalf of Terry Kilbane, court records indicated.

According to sources, a Cuyahoga County Court of Common Pleas jury in October found that defendants Consolidated Rail Corporation and American Financial Group were not liable for Kilbane's alleged asbestos-related injuries.
