NEW ORLEANS - A former reservist who was exposed to asbestos aboard government ships stationed off the coast of Mobile, Ala., cannot seek damages for his alleged injuries in Louisiana, a state appeals court has ruled. Roley v. Eagle, Inc., et al., No. 2002-CA-1466 (La. Ct. App., Fourth Dist.).
Affirming a trial court decision dismissing the lawsuit based on forum non conveniens, the Fourth Circuit Louisiana Court of Appeal held that Alabama would be a much more appropriate forum than Louisiana for the plaintiff's action.
