LAKE CHARLES, La. –– A Louisiana appellate court has reversed a judgment in favor of an asbestos defendant, concluding that lower court’s finding that the claims were prescribed was “clearly wrong.”

In the Nov. 6 opinion, the Louisiana Third District Court of Appeal noted that the decedent was not told he had a malignancy until 2012, not 2008 as the trial court had determined, and found that the plaintiff was never even treated for mesothelioma.
