NEW YORK –– A floor tile manufacturer has been denied summary judgment by a New York court, which found that the plaintiff’s testimony, combined with expert reports, have created facts and conditions from which the defendant’s liability may be reasonably inferred.

In the July 29 order, the New York Supreme Court for New York County noted that, at this stage, the plaintiffs were not required to show the precise cause of damages.
