N.Y. Court Denies J-M Manufacturing’s Efforts to Obtain Summary Judgment in Asbestos Case

NEW YORK –– A New York trial court has denied J-M Manufacturing Company Inc.’s motion for summary judgment in an asbestos case, finding that the plaintiff’s deposition testimony was “cogent and specific” enough to support the underlying claims.

In the July 29 order, the New York Supreme Court for New York County did award the defendant summary judgment on the punitive damages claim, however, concluding that the plaintiff has failed to establish that the defendant’s conduct was intentional or marked by a “high degree of moral turpitude.”
