Punitive Damages Claim Reinstated by N.Y. State Court in Asbestos Case

NEW YORK –– A punitive damages claim in an asbestos case has been reinstated by a New York trial court, which found that the defendant has been put on notice of the claim on the plaintiffs’ complaint and through notice by counsel for the plaintiffs prior to the trial setting.

In the July 29 order, the New York Supreme Court for New York County also vacated an earlier order dismissing the punitive damage claim, accepting plaintiffs’ counsel’s reasoning for not appearing at a motion hearing to address the defendant's efforts to toss the cause of action.
