Flooring Tile Manufacturer Denied Summary Judgment by N.Y. Court in Asbestos Case

NEW YORK –– A New York trial court has denied a motion for summary judgment filed by a flooring tile manufacturer, finding in part that the plaintiff has provided evidence of causation stating that chrysotile fibers can cause mesothelioma.

In a March 29 order, the New York Supreme Court for New York County rejected Mannington Mills Inc.’s challenges to both general and specific causation.

The plaintiffs asserted the claims on behalf of Robert Albin, contending that his lung cancer and colon cancer was caused by exposure to asbestos-containing products, including flooring products manufacturing by Mannington Mills Inc.
