NEW YORK –– CertainTeed’s efforts to obtain summary judgment in an asbestos case asserted on behalf of a former roofer have been rejected by a New York trial court, which found that the conflicting testimonial evidence raises credibility issues best left for a jury to weigh.

In the April 9 order, the New York Supreme Court for New York County found that the company had failed to meet the burden of presenting evidence that would “unequivocally establish” that its roofing shingles could not have caused the decedent’s injuries.
