N.Y. Court Rejects Asbestos Plaintiffs’ Efforts to Reinstate Claims Against Kaiser

NEW YORK –– A New York court has rejected efforts from asbestos plaintiffs to reinstate claims against Kaiser Gypsum, finding that the plaintiff had previously persuaded the court to accept its earlier position that it wanted the defendant out of the litigation.

In the April 8 order, the New York Supreme Court for New York County concluded that “judicial acceptance of the plaintiffs’ current position that it wants Kaiser Gypsum back in this litigation ‘would create the perception that either the first or the second court was misled.’”
