NEW YORK –– A New York court has denied Johnson & Johnson’s motion for summary judgment in an asbestos talcum powder case, finding that the conflicting testimony presented by the parties should be resolved by a jury.

In the Nov. 26 order, the New York Supreme Court for New York County concluded that “the conflicting expert affidavits, the ‘reasonable inference’ standard and construing the evidence in a light most favorable to the plaintiffs … further warrants denial of summary judgment….”
