N.C. Court Tosses Some Claims in Asbestos Case, Allows Negligence, Failure-to-Warn Claims to Proceed

GREENSBORO, N.C. –– A North Carolina federal court has issued an order tossing some claims in an asbestos case, ruling that an insulation supplier was entitled to summary judgment on the punitive damages claim.
In the Aug. 16 order, the U.S. District Court for the Middle District of North Carolina, however, did allow claims of negligence and failure-to-warn proceed.
Plaintiff Ann Finch filed the underlying complaint on behalf of her late husband Franklin Delano Finch, contending that he developed mesothelioma from occupational exposure to asbestos. The decedent worked at a Firestone tire factor for 20 years, where he working in …
