N.Y. Court Denies Efforts to Dismiss Asbestos Talc Case, Says England Not Appropriate Forum

NEW YORK –– A New York trial court has refused to grant a motion to dismiss on forum grounds in an asbestos cosmetic talcum powder case, saying that transfer to England, where the alleged exposure occurred, would create hardship for the plaintiffs.

In the Aug. 15 order, the New York Supreme Court for New York County also found that the plaintiffs had established that New York has a substantial nexus with the underlying action.

The plaintiffs asserted the claims on behalf of Diana Pyle, contending that her mesothelioma was caused by exposure to asbestos in a number of ways, …
