N.Y. Court Tosses Asbestos Cosmetic Talcum Powder Case on Forum Grounds with Leave to Refile in VA, CT

NEW YORK –– An asbestos cosmetic talcum powder case has been dismissed by a New York trial court without prejudice on forum grounds, after the court determined that the only nexus the case had with the state was the location of the corporate defendant.
In the July 2 opinion, the New York Supreme Court for New York County found that the case would be better adjudicated in Connecticut, where the plaintiff was allegedly exposed, or Virginia, where the plaintiffs currently live and where medical treatment has occurred.
