Boiler Manufacturer’s Summary Judgment Motion Denied in Asbestos Case

NEW YORK –– A boiler manufacturer’s efforts to obtain summary judgment in an asbestos exposure case have been denied by a New York trial court, which found that the defendant had failed to meet its burned to establish that its products did not contribute to the decedent’s asbestos-related injury.

In the June 29 order, the New York Supreme Court for New York County concluded that an affidavit proffered in support of the defendant’s motion was inadmissible hearsay and, even if it was admissible, was not enough to award summary judgment.
