Massachusetts Federal Court Grants Motion to Apply Maine Law in Asbestos Case

BOSTON –– A Massachusetts federal court has granted General Electric’s motion to apply Maine law to an asbestos case, concluding that the parties had a “justified expectation” that the law would apply given that the injury took place Maine and the decedent had no contact with GE products in Massachusetts.

In the May 9 opinion, the U.S. District Court for the District of Massachusetts stated that “although the purposes served by the two laws gives this court pause, on balance Massachusetts does not have a more significant relationship than Maine to the occurrence….”
