Calif. Appellate Court Weighs in on Document Production Dispute in Asbestos Case, Says Plaintiff Not Entitled to Limited Production

SAN FRANCISCO –– A California appellate court has weighed in on a document production dispute in an asbestos case, finding that a former Union Pacific employee is not entitled to limited production of documents the defendant claim are privileged since his alleged injuries were not related to his role as a legal consultant with the company.

In the March 16 order, the California First District Court of Appeal opined that if the plaintiff wishes to review the challenged documents, he must demonstrate that they are not, in fact, privileged or subject to work product protection.
