NEW YORK –– A New York court has denied a defendant’s motion to vacate a recommendation allowing a plaintiff to serve disclosure demands regarding successor liability of a foreign corporation that the plaintiff says could be held liable for injuries alleged relating to asbestos-containing cosmetic talcum powder products.
In a Feb. 20 order, the New York Supreme Court for New York County said the plaintiff should be allowed to serve defendant Imerys SA with amended jurisdictional disclosure demands in an effort to see if the defendant can remain in the suit via successor liability.
